GENERAL TERMS AND CONDITIONS

1. AREA OF APPLICATION
SYDNEY Sàrl with registered office Vevey (hereinafter SYDNEY) is an online and offline boutique in children's fashion, toys, decoration and accessories with a sense for design, quality and sustainability. These terms and conditions shall apply to all orders placed on the website http://www.sydneystore.ch The Parties shall only be bound by the Terms & Conditions which are online the day the order is placed.

 

2. ORDERS AND CONTRACT CONCLUSION
Online Orders are placed in the shop. The order is binding when the terms and conditions have been agreed to and the PURCHASE-button has been pushed. Through this a completed and legally binding sales contract is concluded. After receiving your order an e-mail confirming the order will be sent to you.

 

3. DELIVERY AND SALE CONDITIONS
After the order confirmation, we will send the ordered articles to the address declared by you in a nice package. The shipping adress cannot be modified. The usual delivery time with economy shipping is 3-5 workdays and with priority 1-2 workdays.

For orders from abroad delivery time can be up to 14 workdays longer. Should delivery not be possible after several tries, SYDNEY can withdraw from the contract.
 

4. OFFER
Our online offer is subject to change and non-binding. In general the articles offered in the online shop are available. Should it not be possible to deliver one or more articles due to stock variation SYDNEY will inform you about the circumstances as quickly as possible and offer you comparable articles. If none of these appeal to you, the amount due will be reimbursed.

 

5. PRICES
Our retail prices are calculated ex-stock and are stated in Swiss Francs including legal value-added tax and excluding shipping charges.

6. SHIPPING COSTS
We deliver worldwide.

6.1 SHIPPING COSTS
For deliveries in Switzerland or the Principality of Liechtenstein shipping costs are CHF 7 (economy) or CHF 9 (Priority). Oders with goods valued above CHF 100 no shipping costs will be charged.

The shipping costs are a mixture of all package sizes up to 30 KG. Depending on the size of the items, a an appropriate cardboard box is used, as well as the necessary franking. The charged amount consists of the effective postage costs, packaging, shipping material, commissioning,  and postage.

7. PAYMENT METHODS
For orders in Switzerland or the Principality of Liechtenstein the following payment methods are available: bank transfer, credit card and TWINT. Orders from abroad can only be paid for by credit card.

 

7.1  BANK TRANSFER
For payment on bank transfer you will receive the invoice per e-mail and by mail. The payment is due within 3 days after the order is made.  In comparison to other payment methods, there are no surcharges with this method of payment.

7.2 CREDIT CARD, TWINT (E-PAYMENT)
Orders can also be paid for by e-payment (PostFinance card/PostFinance e-finance) or by credit card (VISA or MasterCard) through the safe payment system SUM UP. Possible fees from the credit card company may be charged to you.

8. GIFT VOUCHERS
Gift vouchers are vouchers, which you can purchase instore or online.

You can use a voucher from SYDNEY in store only (Rue de la Madeleine 33 A, 1800 Vevey ). 

The amount of the voucher is predetermined. The vouchers are issued exclusively in CHF and are non transferable.

 

9. RETENTION OF TITLE
The ordered products remain property of SYDNEY  until they have been fully paid for.

 

10. REVOCATION RIGHT/RIGHT OF RETURN
You have the right to withdraw from the contract within 14 days after receiving the merchandise, through returning the merchandise with a reason for return. Returning the merchandise is to your responsibility and costs.

The articles must be returned in the original unglued and undamaged packaging. Only immaculate, completely intact and unworn articles will be taken back. Particularly worn, dirty, damaged or badly smelling products can’t be taken back. If this is not the case, we reserve the right to assert compensation claims.

The value of the returned article  will be given as a voucher reimbursement. Shipping costs will not be refunded.

11. DELIVERY DEFECTS
We ask you to examine the correctness, completeness and intactness of received articles. Complaints regarding the scope of delivery, material defects, incorrect delivery and quantity deviations are to be reported to us within 5 working days after receipt, per letter. Shortcomings will be examined by SYDNEY immediately, If SYDNEY accepts the shortcoming, and the article is still in stock, you will receive a replacement and shipping costs will be reimbursed. Otherwise the full amount will be reimbursed.

 

12. WARRANTY
Warranty of purchased articles is limited to the warranties of the respective producers. Claims cease to exist if there is improper handling or personal intervention.

 

13. PRIVACY
Protecting your personal data is very important to us. We follow the applicable data protection regulations and secure your data against unauthorised access of a third party (data security precautions).

Our online shop is encrypted through SSL (Secure Socket Layer), which safely transfers all data concerning the supply as well as your payment and personal data to us SYDNEY is authorised to use your personal data to provide you with special offers or information about our new collection. You can revoke your consent to the use of your personal data for commercial purpose anytime by writing an e-mail to hello@sydneystore.ch. Using technological and organisational measures we secure our website and other systems against loss, deletion, access, change and distribution of your data through unauthorised people. 

This website contains a Facebook and Instagram-button. Through activating these buttons you get into direct contact with the social network Facebook and Instagram. Facebook and Instagram may use the personal data of it’s users in a way that doesn’t comply with data protection, since utilisation of the data may not provide enough information. SYDNEY Sàrl is not liable for any damage that may arise through abusive use of your personal data through Facebook or Instagram.

 

16. APPICABLE LAW AND AREA OF JURISDICTION
The contractual relationship between you and SYDNEY shall be governed by Swiss material law under exclusion of the UN convention on the International Sale of Goods of 11.April 1980 (UN sales law). Area of jurisdiction for all disputes is Vevey, SYDNEY Sàrl  is further authorised to electively call upon the court at the seat/domicile of the customer.
